OUR ITEM OF BUSINESS THIS EVENING IS TO CONSIDER APPROVAL OF A FINAL PLAT OF SCHUMAC LANE ESTATES ADDITION, BLOCK 1, LOTS 1 AND 2 BEING 5.651 ACRES OUT OF THE J.W.SHACKLEE SURVEY, ABSTRACT 1390. PROPERTIES LOCATED SOUTH OF SCHUMAC LANE AND SHANNON LANE.

THE PROPERTY IS LOCATED OFF OF SCHUMAC AND SHANNON HAS ACCESS FROM BOTH.
I'M JUST GOING TO BREEZE THROUGH SOME OF THE BACKGROUND REAL QUICK.
OBVIOUSLY IF YOU'VE SEEN THE PROPERTY, YOU KNOW, IT'S HEAVILY WOODED. THERE'S A LARGE DRAINAGE CHANNEL THAT RUNS THROUGH IT, WHICH IS DESIGNATED AS FLOODPLAIN. APPLICANTS PROPOSING TO SUBDIVIDE THE LOT INTO TWO DIFFERENT LOTS FOR SINGLE FAMILY USES, ACCESS BEING FROM SHANNON LANE. THERE IS A WATERLINE EXTENSION THAT IS A PART OF THIS TO ADDRESS WATER PRESSURE AND FIRE PROTECTION ISSUES.
I TRIED TO MARK UP THE PLAT TO GIVE YOU A LITTLE BIT OF CONTEXT HERE.
YOU'VE GOT OBVIOUSLY THE RED LINE OUTLINES THE BOUNDARIES OF LOT 1, WHICH IS ABOUT FIVE ACRES.
SO LOT ACCESS IS COMING OFF SHANNON LANE. TO DO A LITTLE BIT DEEPER DIVE AND INSTEAD OF MARKING IT UP, I THOUGHT IT WOULD BE EASIER JUST TO SHOW YOU A COPY OF THE FLOODPLAIN MAP FOR THIS AREA.
AND YOU CAN SEE WHERE ALONG SUMACH AND EXTENDING TOWARD THE SOUTH, THE THE FLOODPLAIN AND FLOODWAY.
STAFF IS RECOMMENDING APPROVAL. IT DOES MEET ALL THE ZONING AND SUBDIVISION REQUIREMENTS OF THE, OF LOCAL ORDINANCES AND THE TEXAS LOCAL GOVERNMENT CODE.
WE ARE RECOMMENDING APPROVAL WITH FIVE CONDITIONS.
THERE'S SOME DEDICATED EASEMENTS THAT ARE ALREADY ON THIS PROPERTY.
WE NEED TO HAVE THE RECORDING INFORMATION ON THOSE.

SO THIS TURNED INTO A FINAL PLAT. SO THAT CHANGED THE APPROVAL BLOCK.
YES. I THINK THIS IS PROBABLY BEFORE YOU CAME HERE AND BEFORE MOST OF US ON PLANNING AND ZONING.
THAT SUBDIVIDED PRETTY MUCH. I CAN GO BACK, AND I FORGET HOW MANY LOTS, BUT IT WAS A NUMBER OF LOTS.
THAT CLEARLY DIDN'T TAKE INTO CONSIDERATION THE FLOODPLAIN ISSUES THAT WE HAVE ON THIS PROPERTY.
AND SO THAT'S JUST NOT A FEASIBLE PLAN. SO THAT PRELIMINARY PLAT NEVER WENT PAST THAT STAGE.
IT SEEMS TO ME, AND I'M TRYING I CAN'T REMEMBER HOW MANY YEARS AGO YOU PROBABLY GOT SOME RECORDS ON THAT, BUT IT WENT BACK. I REMEMBER A NUMBER OF NEIGHBORS COMING, AND I THINK THEY WERE OPPOSED, AND I'M JUST TRYING TO MAKE SURE THAT WE'RE NOT GOING DOWN THE WRONG PATH.
NO, THAT I MEAN, I DON'T KNOW WHY THEY WOULD HAVE BEEN OPPOSED.
YOU'VE GOT ONE LOT AGAIN, THAT'S FIVE ACRES. YOU'VE GOT ONE ANOTHER LOT THAT'S OVER HALF AN ACRE.

SO CLEARLY, WE MEET ALL THE ZONING REQUIREMENTS.
THERE, YOU KNOW, IF THERE'S A QUESTION ABOUT TREES, THERE ARE A LOT OF TREES ON THIS LOT.
WE'VE WORKED WITH THE PROPERTY OWNER. THEY'VE PROVIDED US WITH A TREE SURVEY, BUT WITH THE NUMBER OF TREES THAT THEY'RE PLANNING TO TAKE OUT, IT WON'T COME ANYWHERE NEAR NEEDING TO MITIGATE ANYTHING BECAUSE THERE'S ALREADY SO MANY TREES ON THE LOT.
I JUST REMEMBER THERE WERE A LOT OF PEOPLE MAY HAVE BEEN THAT THE ISSUE OF FLOODPLAIN CAME UP, AND I THINK THAT I DON'T KNOW IF THIS GENTLEMAN WILL LET HIM COME UP AFTER YOU SPEAK.

IT'S GOING TO BE FURTHER BACK TO THE SOUTH. RIGHT.
YEAH, YEAH. AGAIN, BOTH LOTS ARE BEING ACCESSED OFF OF THAT ACCESS EASEMENT THERE THAT'S IN YELLOW.

OR DEEP FRONT YARD, BIG FRONT YARD, WHICHEVER HOWEVER YOU WANT TO LOOK AT IT.

AND AS I READ THE STATUTE AGAIN, EVEN THOUGH IT'S BEEN REVISED, THERE WAS A CASE AGAINST THE EPA THAT WAS FOUND BASICALLY IN THE FAVOR OF MOST PEOPLE THAT WANT TO DEVELOP PROPERTY.THAT SAID, THAT IF THE WATERWAY HAS A RELATIVE, IS RELATIVELY PERMANENT WITH STANDING OR CONTINUOUSLY FLOWING WATER, THAT IT NEEDS THAT YOU NEED TO DEAL WITH THE CORPS OF ENGINEERS OR AT LEAST CONTACT THEM.
IS THAT IS THAT BEEN DONE AS FAR AS YOU KNOW? NO, BUT THEY'RE NOT CHANGING ANYTHING ON THIS.
SO THEY'RE NOT THEY'RE NOT DOING ANY WORK IN THE FLOODPLAIN AT THIS POINT.

IT MEETS ALL OF OUR STANDARDS. SO THERE'S REALLY NO CONCERN FROM A STAFF STANDPOINT.

AND THE CORPS OF ENGINEERS SHOULD BE PERFECTLY HAPPY, AND WE DON'T HAVE TO DEAL WITH THEM. I MEAN, THEY COULD HANG A SWING ON A TREE, THAT'S NOT GOING TO MATTER, RIGHT? OKAY.
