A LITTLE BIT OF BACKGROUND AND SUMMARY ON THE APPLICATION.
MASSAGE SALONS WITHIN THE CITY OF BEDFORD REQUIRES A SPECIFIC USE PERMIT ACROSS ALL PERMITTED COMMERCIAL ZONING DISTRICTS.
THE SUBJECT PROPERTY WAS DEVELOPED IN 1982 AS A SINGLE-STORY COMMERCIAL RETAIL CENTER WITH APPROXIMATELY 84,000 SQUARE FEET OF LEASE SPACE.
THERE ARE SEVERAL MIX OF USES AT THE LOCATION RIGHT NOW, SEVERAL RETAIL, TWO RELIGIOUS FACILITIES, AND JUST A MIX OF THAT TYPE OF STUFF.
ACCORDING TO THE APPLICATION, THERE'S THREE EMPLOYEES ON SITE OPERATING EVERY DAY OF THE WEEK, MONDAY THROUGH SUNDAY FROM 9:30 AM TO 9:30 PM.
THE PROPOSED LOCATION WOULD OCCUPY A 2,510 SQUARE FOOT SUITE WITHIN THE SHOPPING CENTER, WHICH IS 727 HARWOOD ROAD.

FURTHER TO THE PROPERTY SPECIFICALLY.
THE LOCATION PREVIOUSLY OPERATED AS A MASSAGE SALON, IT RECEIVED A CERTIFICATE OF OCCUPANCY DATING BACK FROM 2021 PER MUCH AS RESEARCH AS WE'VE BEEN ABLE TO DO.
THE LOCATION HAS BEEN VACANT SINCE APPROXIMATELY DECEMBER OF 2023.
IT'S BELIEVED THAT THE PRIOR LOCATION, THE PRIOR BUSINESS OPERATED AS A NON-CONFORMING USE.
THEY OBTAINED A CERTIFICATE OF OCCUPANCY, DID NOT HAVE A SPECIFIC USE PERMIT.
HOWEVER, SECTION 6.1.E OF THE ZONING ORDINANCE STATES THAT ANY LOCATION THAT'S BEEN VACANT FOR OVER THREE MONTHS LOSES NON CONFORMITY, AND SO THAT'S THE CASE HERE.
SINCE THEY'RE TRYING TO COME BACK AS A MASSAGE SALON, THEY HAVE TO GO BACK TO THE PROCESS ALL OVER AGAIN OR GO THROUGH THE PROCESS INITIALLY TO RECEIVE THAT APPROVAL TO THEN APPLY FOR THE CERTIFICATE OF OCCUPANCY.
ZONING MAP. THIS LOCATION IS LOCATED IN HEAVY COMMERCIAL.
THE LOCATION IS RIGHT THERE WITH A RED STAR.
WE HAVE A PLANNED UNIT DEVELOPMENT TO THE EAST, WHICH IS A MIX OF BOTH COMMERCIAL AND TWO RESIDENTIAL COMPONENTS TO THAT.
IT'S WEIRD. NORTH OF THAT IS A RESIDENTIAL COMPONENT, WEST OF THAT WOULD BE OFFICE BUILDINGS, AND THEN SOUTH WOULD BE A PLAN UNIT DEVELOPMENT WITH A MIX OF TOWNHOMES, GARDEN HOMES, THAT TYPE OF STUFF.

WE RECEIVED ONE RESPONSE TO A NOTIFICATION WRITTEN IN OPPOSITION.
WE RECEIVED A COUPLE OF PHONE CALLS, BUT NOTHING WRITTEN.
THE ONLY OPPOSITION THAT WE RECEIVED IS THAT [INAUDIBLE]. STAFF FINDINGS.
THE SITE IS CURRENTLY DEVELOPED AND DOES NOT REQUIRE ANY EXTERIOR CHANGES.
THE LOCATION LOST NONCONFORMITY BEING VACANT FOR OVER THREE MONTHS.
THE PROPOSED MASSAGE SALON DOES NOT MEET THE GOALS OF THE COMPREHENSIVE PLAN, OUTLINED DINING, RETAIL, AND ENTERTAINMENT.

NOW, WITH THE APPOINTMENTS, SHE'S GETTING A LOT OF LADIES THERE COMING IN AND A LOT MORE CONSISTENCY, SO THEY'LL COME IN AND BOOK ANOTHER FOR THE NEXT MONTH.
THEN THAT MAKES IT ALL EASIER, BUT WITH LOOKING AT THAT, WE'RE ALSO LOOKING AT THE TERMS OF LEASE AND FINDING THAT SHE NEEDS SOMETHING A LITTLE BIGGER AND MAYBE CLOSER TO HOME, AND HURST WERE JUST LIKE A FEW MINUTES AWAY FROM THIS AREA.
WE WEREN'T AGGRESSIVELY LOOKING, BUT WE WERE LOOKING AT DIFFERENT PLACES.

THIS SEEMED LIKE A NICE WELL WE SEEN CARS THERE.WHAT WE STARTED LOOKING AT WAS THERE'S LIKE A HEALTH HUT RIGHT NEXT DOOR WHERE THEY FOCUS ON HEALTH, AND THEN THERE'S A GYM AND A NAIL SPA THERE, AND SO WE THOUGHT THAT WOULD FIT RIGHT IN THERE.
PLUS, I'M THE ONE DOING THE CONSTRUCTION ON THE OTHER ONES, AND A LOT OF THEM ARE JUST OPEN, NO CEILING.
WE SPENT A LOT OF MONEY AND TIME TRYING TO GET TO OPEN AND FEASIBLE.
SINCE IT WAS A PRIOR SPA, IT HAS ALL THE DOORS AND ALL THE PLUMBING IS THERE.
THERE'S A SINK AND A PLACE WHERE TO WASH AND STUFF LIKE THAT.
ALL THE DOORS ARE THERE AND THE FLOORING IS THERE.
[NOISE] WE WERE TOLD SO THAT'S WHY WE'RE DOUBLING THE SQUARE FOOTAGE, AND THAT'S WHY IT'S GOING LARGER.
TO ANSWER YOUR QUESTION, WE'RE GOING TO HAVE THREE THERE NOW BECAUSE SHE USUALLY RUNS WITH ONE AND THE 900 SQUARE FEET, AND TWO EMPLOYEES IS AT THE OTHER ONE.
WITH IT BEING APPOINTMENTS, SHE CAN BE THERE WITH THEIR STAFF, AND SHE'S THE THIRD ONE, WHICH IS RARELY THERE.
BUT WITH THIS ONE, WE'RE GOING TO HAVE TO HAVE THREE RIGHT OFF THE BAT.
IT TAKES A LITTLE TIME, BUT WITH ALL THIS HEALTH THERE AND THESE GYMS, WE JUST LOOKED AT IT AND SAID, "OKAY.
SO WE PROBABLY GET TO SOME APPOINTMENTS RIGHT AWAY, AND WE MIGHT HAVE TO PAY FOR SOME ADVERTISING SINCE THIS IS A NICE AREA AND GET IT GOING FASTER." HER OTHER ONES ARE DOING GREAT, AND SHE'S GOT GREAT REVIEWS, AND SHE GOES THROUGH HER TDLR, THEY COME IN EVERY YEAR, AND SHE'S GOT EVERYTHING'S GOING GOOD.
THERE'S NO PROBLEMS. BUT WHAT GOT US HERE IS I TALKED TO A REALTOR, AND WE WERE LOOKING AT ONE NEXT DOOR.
WE SAID THAT WAS TOO SMALL, AND I DIDN'T REALLY WANT TO BUILD OUT, AND THE CEILING WAS MISSING, AND I KNOW HOW MUCH THAT IS TO DO ALL THAT AND TO GET THE CONTRACTORS AND THE CERTIFICATE OF OCCUPANCY.
HE FOUND THIS. HE SAID, "THIS ONE IS OPEN." WE SEEN THAT BEFORE, BUT WE DIDN'T THINK IT WAS AVAILABLE BECAUSE IT HAS A NICE WALK-IN FROM THE GLASS.
YOU CAN SEE IT LOOKS NICE, LIKE WITH A STONE DESK ENTRYWAY, AND IT'S ALL LIT UP, SO THERE'S IT'S NOT DARK, LIKE YOU SEE A LOT OF MASSAGE BECAUSE RIGHT NOW, YOU SEE THAT IT IS HARD WITH ALL THESE MASSAGE PLACES.
I'VE NOTICED IN THE PAPERS READING THAT WHERE THERE'S SOME PROBLEMS, AND THAT'S WHAT THE REALTOR AND THE LANDLORD SAID.
THAT'S WHY WE WENT THROUGH A LOT OF SCRUTINY TO EVEN GET TO THIS.
THAT'S WHY THEY LOOKED AT OUR REVIEWS.
OUR REALTOR WENT AND LOOKED AT OUR OTHER PLACE AND SAID, "YEAH. BECAUSE WE LIKE IT.
IT'S LIT UP AND WITH THE REVIEWS AND EVERYTHING." WE STARTED THE PROCESS, GOT THE LEASE GOING, AND TALKED TO THE LANDLORD, AND THEY SAID, "OKAY.
IT'S GOOD TO DO THE MASSAGE." I GOT IT CHEAPER BY THE SQUARE FOOT BECAUSE I COULD GET SOMEBODY TO PUT IN PART OF THE FLOOR, AND WE COULD KEEP SOME OF THE FLOOR, AND NOT HAVE THEM COME IN AND REPAINT AND DO ALL THE FLOORING, WHICH WOULD PUT THE SQUARE FOOTAGE RATE UP THERE.
WITH THE LANDLORD AGREEING TO THE MASSAGE AND THE REALTOR SAYING.
THE LAST WALK THROUGH WE DID WAS IN JANUARY.
MY MOTHER'S A REALTOR, AND SHE HAS HER LICENSE IN TEXAS, BUT IT'S MORE RESIDENTIAL.
BUT I ASKED IF SHE WANTED TO TAKE A LOOK AT IT, AND SHE WAS VISITING FOR THE HOLIDAYS.
SHE EVEN ASKED, AND I ASKED THE REALTOR AND SAID, "THIS IS ZONED." OF COURSE, IT IS. THIS IS A MASSAGE.
YOU CAN SEE, IT'S ALREADY BUILT OUT.
THEN I HAD ALREADY CALLED BEDFORD WHEN I STARTED LOOKING.
I CALLED AND I TALKED TO SECRETARY AND FOUND OUT THAT YES, THERE'S SOME PLACES THAT ARE ZONED AND SOME THAT AREN'T.
I SAID, "OKAY. WELL, WE'LL NAIL IT DOWN AND GET AN ADDRESS." SHE SAID, "CALL BACK WHEN YOU GET AN EXACT ADDRESS." WHEN WE FOUND THIS ONE, I CALLED BACK AND I MENTIONED THIS ADDRESS, AND THEN SHE SAID SHE HAD PROBLEMS. I DON'T KNOW IF SHE COULD GET A HOLD OF THE PERSON RIGHT AWAY AND WANTED TO FORWARD ME TO HIS VOICEMAIL.
AND SHE SAID SHE COULD NOT LOCATE IT RIGHT AWAY, BUT SHE SAID THE LEASING AGENT, A REALTOR, WOULD KNOW.
SO THAT'S WHY I ASKED HIM MANY TIMES.
THAT'S LIKE, WE WOULDN'T HAVE TRIED TO GO AFTER THE HARD WAY OF DOING THIS BECAUSE THIS WAS JUST RELAXED, DRIVING AROUND AND LOOKING AT OPEN PLACES.
WE UNDERSTOOD THAT THIS WAS ALREADY ZONED WHEN WE WENT AFTER IT AND LOOKED AT THE DEAL WE HAD AND THE SQUARE FOOTAGE,

WE DON'T NEED ANY ELECTRICAL OR ANYTHING DONE.
I WENT TO GET THE ELECTRICITY TURNED ON, AND WE GOT TO CHANGE THE AMA WITH THE SECRETARY OF STATE, AND WE'RE OVER $8,000 ALREADY, AND THIS WAS A BIG SHOCK.
BECAUSE ELECTRICITY WASN'T ON BY MONDAY.
THEN THAT'S WHEN THEY SENT ME A LITTLE DEEPER AND SAID, "IT'S NOT ZONED."
I CALLED THE REALTOR BACK AND SAID, WHY DID YOU WRITE THIS LEASE? WHY DID YOU SAY THIS? I SAID, THIS IS GOING TO COST A LOT OF MONEY, BECAUSE, WE WERE PLANNING ON THAT'S WHY THE DEAL, I DIDN'T WANT TO DO THE FLOOR.
EVERYTHING WAS GOING TO GO FASTER, AS FAST AS I COULD GET THE PAPERWORK TO GO THROUGH THE TDLR, WE COULD GET THIS UP AND RUNNING.
NOW IT STILL SITS VACANT, AND, $8,000 LATER, WE HAVEN'T DONE ANYTHING TO IT, WE STARTED BUYING THINGS AND COMING IN THE BACK, STARTED CLEANING THAT WEEKEND AND SWEEPING, AND I'M TAKING NOTES WHERE I NEED TO, FIX WHAT NAIL HOLES, WHAT COLORS WE'RE GOING TO DO THE WALLS.
THEN MONDAY MADE THE CALLS, SO WE JUST WENT AND IT'S BEEN VACANT.
WE HAVEN'T WENT BACK IN THERE. LEFT IT.
IT'S VERY NICE, AND LIKE I SAID, WITH THE HEALTH, AND THERE'S A GYM, AND THERE'S A NAIL SALON, AND IT'S A LITTLE CLEANER THAN THE OTHER PLACES WE GOT.

BUT THAT'S I WANTED TO MAKE SURE, TO LET YOU GUYS KNOW THAT THIS WAS NOT PLANNED TO COME AND BUSTED INTO SOME AREA THAT WASN'T EVEN ZONED.
THEN COMMERCIAL, I DIDN'T REALLY UNDERSTAND THE COMMERCIAL HEAVY BECAUSE OF THESE SMALL, THE LIKE A THRIFT STORE RESALE THERE AND THE GYM.
THERE'S JUST SMALL LITTLE PLACES, AND I TALKED TO THE LADY NEXT DOOR, AND SHE HAS THE HEALTH SPOT OR THE HEALTH HUT, SHE CALLS WITH ALL HEALTH MEDICINES AND STUFF LIKE THAT.
SHE LOVED IT BECAUSE SHE SAID SHE WOULD GET MORE BUSINESS.
THEN I TALKED TO ANOTHER LADY THAT WAS MOVED IN THERE, AND SHE SAID.
THIS IS GREAT THE RESALE PLACE, AND SHE SAID, I HAVEN'T EVEN ADVERTISED YET.

THEY MIGHT WANT TO SELL IT, BUT HE'S RISKING HIS LICENSE.
THAT'S WHERE WE'RE AT AT THIS PLACE AT THIS POINT WHERE WE GIVE FALSE INFORMATION, OR CAN WE GET THE CITY TO APPROVE SINCE IT'S ALREADY BUILT OUT, AND IT'S ALREADY A MASSAGE, AND IF THEY LOOK AT OUR OTHER TWO ESTABLISHMENTS, THAT WE HAVEN'T HAD ANY TROUBLE WITH THE TEXAS LICENSING AT ALL.
I'M SPEAKING FOR MY WIFE BECAUSE WE'VE BEEN MARRIED 2.5 YEARS AND WE'VE BEEN TOGETHER ABOUT 3.5 YEARS.

BUT THIS GUY, HE SAYS, I DRIVE 50 MILES, AND THEN I'M BRINGING MY DAUGHTER BECAUSE, LOOK AT THIS.
