WE ALSO ASK THAT YOU PROTECT AND PROVIDE GUIDANCE TO THE CITY COUNCIL AND CITY STAFF AS THEY WORK FOR THE BETTERMENT OF ALL BEDFORD CITIZENS.

OKAY. TONIGHT WE HAVE A. WE WILL CONDUCT A PUBLIC HEARING AND CONSIDER APPROVAL FOR FINAL PLAT FOR LOTS ONE THROUGH

Conduct a public hearing and consider approval of a final plat of Lots 1-19, Block 1, and Lot 1-23, Block 2, Grace Park Addition, being a replat of a portion of Lot 1, Block 1, Woodland Heights Addition and a portion of the Garrett Teeter Survey, consisting of 8.691 acres, generally located on the south side of Cheek-Sparger Road and east of Central Drive. (PLAT-24-3) ]

GRACE PARK ADDITION BEING A REPLAT OF A PORTION OF LOT ONE, BLOCK, ONE WOODLAND HEIGHTS ADDITION, AND A PORTION OF THE GARRETT TEETER SURVEY CONSISTING OF 8.691 ACRES, GENERALLY LOCATED ON THE SOUTH SIDE OF CHEEKTOWAGA ROAD AND EAST OF CENTRAL DRIVE PLAT. 24-3 REPORT FROM STAFF, PLEASE.

YEAH. ALL RIGHT. SO I BELIEVE THIS PROJECT IS ONE THAT'S BEEN IN MOTION FOR A MINUTE.

AND SO FOR SOME OF Y'ALL THAT HAVE BEEN ON THE COMMISSION, YOU ALL HAVE SEEN SOME ITERATION OF THIS PROJECT BEFORE.

THIS WILL BE MY FIRST TIME PROCESSING SOMETHING WITH IT.

SO HERE WE GO. OKAY. SO AS I SAID, IT'S BEEN BEFORE P&Z BEFORE IN CITY COUNCIL.

IT'S LOCATED RIGHT OFF CENTRAL DRIVE IN CHEEKTOWAGA ROAD TO THE SOUTH.

AND IT CONNECTS THROUGH BOTH STREETS. SO TODAY WE'RE HERE TO SEE THE FINAL PLAT.

THE PRELIMINARY PLAT ON THIS PROPERTY CAME THROUGH IN APPROXIMATELY JANUARY 2024 WITH THE REZONING PROCEEDING THAT IN NOVEMBER OF 2023 TO MD THREE. SO ACCESS TO THE PROPERTY OR TO THE HOMES, RATHER, IS GRANTED BY A 50 FOOT PUBLIC RIGHT OF WAY FROM BOTH CENTRAL DRIVE AND [INAUDIBLE] ROAD, WHICH IT WILL BE LEGACY OAKS LANE EAST TO WEST AND THEN GRACE PARK LANE NORTH AND SOUTH.

AND THIS IS APPROXIMATELY A 40 SINGLE FAMILY HOMES LOT WITH TWO OPEN SPACES.

AND THOSE TWO OPEN SPACES WOULD BE ONE TO THE WESTERN PART OF THE PROPERTY, LITTLE SLIVER, AND THEN WOULD BE LOT 15, WHICH I THINK I HAVE A LASER POINTER HERE.

I CAN'T SEE IT WOULD BE LOT 15 WOULD BE A COMMON AREA JUST BEFORE THE LITTLE CURVE TO THE SOUTH-SOUTHEAST PORTION OF THE PROPERTY.

SO THERE'S TWO COMMON LOTS AND THE REST WOULD BE THE 40 SINGLE FAMILY RESIDENTIAL HOMES ON THIS PROPERTY.

SO PUBLIC HEARING IS REQUIRED BECAUSE THE PROPERTY IS ZONED RESIDENTIAL AND A PORTION OF THE PROPERTY WAS PREVIOUSLY PLATTED WITH THE ADJACENT CHURCH. ONE NOTIFICATION WAS MAILED OUT TO THE CHURCH REFERENCED THIS PUBLIC HEARING AND THE REPLAT.

HOWEVER, UP TO NOW, WE'VE GOTTEN NO RESPONSE OR NOTIFICATION OR ANY SORT OF COMMUNICATION FROM THE CHURCH OR ANYONE ELSE FOR THAT MATTER.

SITE PHOTOS. SO WITH THE PRELIMINARY PLAT HAVING GONE THROUGH A LITTLE OVER A YEAR AGO, THERE'S BEEN SOME MOVEMENT ON THE PROPERTY.

INFRASTRUCTURE HAS PASSED OUR 75% THRESHOLD FOR DEVELOPMENT, WHICH MEANS WE PROCESS THE FINAL PLAT FORWARD A LITTLE BIT OR NOT A LITTLE BIT THE WHOLE WAY. AND THE NEXT STEP AFTER THIS WOULD BE PROCESSING BUILDING PERMITS AND GETTING HOMES UP THERE.

BUT THIS WILL BE THE LAST HURDLE BEFORE WE GET TO THAT. SO, YES, THESE PHOTOS OVERLOOK THE PROPERTY FROM CENTRAL DRIVE.

AND THEN THE BOTTOM RIGHT PICTURE WOULD BE FROM LOOKING SOUTH FROM BAJA ROAD.

SO THE TWO ENTRANCES. SO, ON THE OPPOSITE DIAGONAL ENDS.

SO STAFF FINDINGS AND RECOMMENDATIONS. SO THE PROPOSED FINAL PLAT IS IN CONFORMANCE WITH THE APPROVED CONCEPT PLAN WITH MD3 ZONING IN THE PRELIMINARY PLAT THAT WENT WITH THE

PROPERTY. IT'S IN COMPLIANCE WITH THE SUBDIVISION REGULATIONS OF THE CITY, AND THE FINAL PLAT MEETS THE REQUIREMENTS OF CHAPTER 212 OF THE LOCAL GOVERNMENT CODE.

AND THE INFORMATION HERE SHOWS THAT 710 CALIPER INCHES OF PROTECTED TREES.

NOW, THEY WEREN'T PROTECTED TREES WHEN YOU CAME HERE, BUT THEY ARE.

AND SO WHAT I'M ASKING YOU IS WOULD YOU BE WILLING TO YOU.

YOU DON'T HAVE TO DO ANYTHING. YOU DON'T HAVE TO CONTRIBUTE TO A TREE FUND.

I DON'T HAVE THEM OFF THE TOP OF MY HEAD, BUT THE MAJORITY OF THOSE TREES WERE UNPROTECTED PER THE ORDINANCE.
