CONSIDER AND MAKE RECOMMENDATION TO CITY COUNCIL REGARDING THE CLASSIFICATION OF NEW AND UNLISTED USES PER SECTION 3.3 OF THE ZONING ORDINANCE PERTAINING TO SPECIALTY CANDY, MANUFACTURING, PACKAGING, AND RETAIL STAFF REPORT.

UM, THIS IS ACTUALLY A STAFF REQUEST BEING BROUGHT TO THE P AND Z, UM, AS WE LOOK TO YOU TO MAKE AN INTERPRETATION IN THE ZONING ORDINANCE.

SO THIS IS NOT AN APPLICATION FOR MY SPECIFIC BUSINESS TONIGHT, ALTHOUGH A PARTICULAR BUSINESS, UM, SHOWING AN INTEREST IN LOCATED IN BEDFORD IS WHAT PROMPTED.

UM, THEY NEED TO HAVE YOU ALL TAKE A LOOK AT OUR ORDINANCE AND SEE WHERE THIS TYPE OF USE BEST FITS AND WE CAN MOVE FORWARD.

THEN WITH, WITH THAT, TO GIVE YOU AN IDEA, AGAIN, THE GROUP THAT HAS COME FORWARD HERE ARE SOME OF THE CHARACTERISTICS OF THE BUSINESS.

I WILL SAY THAT THE CURRENT BUSINESS IS LOOKING AT GOING WITHIN THE SERVICE COMMERCIAL DISTRICT, WHICH IS ONE OF THE LOWEST INTENTS OF OUR COMMERCIAL DISTRICTS.

SO AGAIN, INTENDED FOR LOW INTENSE TYPE USES.

AND WE ARE HERE UNDER THE GUIDANCE OF SECTION 3.3, WHERE WE LOOK TO YOU FOR THE INTERPRETATION.

SO THIS IS WHY WHEN WE GET TO THE NEXT ONE, THIS IS WHERE STAFF FELT.

THE OTHER ONE WAS A LITTLE MORE ALIGNED BECAUSE THERE'S AN ACTUAL PROHIBITION IN THIS.

SO WE MAY NEED TO LEAN ON OUR CITY ATTORNEY A LITTLE BIT, BUT IF THIS IS THE CATEGORY THAT YOU ALL WOULD BE INTERESTED IN PLACING THIS USE, I BELIEVE WE WOULD PROBABLY HAVE TO AMEND IT TO TAKE AWAY THE PROHIBITION.

I DON'T KNOW THAT IF I KNOW, AND WE KNOW THAT, UM, OFF-PREMISE SALES ARE GOING TO HAPPEN TO A DEGREE, THAT'S A LARGE PORTION OF THEIR BUSINESS, IF WE CAN PLACE IT IN THIS CATEGORY.

SO WE MAY HAVE TO LEAN ON OUR CITY ATTORNEY IF THAT IS OF INTEREST FOR YOU.

BUT AGAIN, BAKERY AND CONFECTION SHOPS ARE KIND OF ADMITTED MY RIGHT IN THE SERVICE LIGHT COMMERCIAL AND HEAVY COMMERCIALS, ZONING DISTRICTS.

AND AGAIN, JUST MY EXPLANATION AS TO WHY I DID NOT ORIGINALLY ALIGN THIS WITH THAT DISTRICT BECAUSE OF THE OFF-PREMISE SALES DOES NOT ALIGN WITH THAT.

THE SECOND CATEGORY AGAIN, MOST APPLICABLE IS THE CANDY AND CONFECTIONARY MANUFACTURING AND PACKAGING FACILITIES FOR MANUFACTURING AND PACKAGING OF CANDY AND CONFECTIONARY PRODUCTS PRETTY BROAD IN GENERAL.

UM, BUT DOES ENCOMPASS THIS USE AND IT IS PERMITTED BY RIGHT IN THE INDUSTRIAL DISTRICT ZONING.

THIS IS THE USE THAT AGAIN, BASED ON STRICTLY LOOKING AT THE OPERATIONS AND THE ACTIVITIES AND THE TWO DISTRICTS THAT WE DO HAVE THIS ONE IS THE ONE THAT WE DID FEEL, UM, COVERED THE BASIS WOULD GIVE US THE LEGAL ABILITY TO CLASSIFY THIS USE IN THAT DISTRICT.

SO THERE ARE OPTIONS FOR LEASES TO OCCUR WITHIN THAT MOST DEFINITELY.

UM, BUT IN OTHER RESTRICTIONS OF 300 FOOD TO CORRECT AGAIN, THAT ALCOHOL COMPONENT COMPLETELY BEING SET ASIDE FOR A DIFFERENT CONVERSATION, BUT YES.

UM, WE DO HAVE, UM, SEVERAL AREAS KIND OF IN THE TRIANGLE OF 1 21, 180 3 TOWARDS ULOUS, UH, WHERE WE DO HAVE SEVERAL, UM, LIGHT INDUSTRIAL AND SOME FLEX SPACES AS I LIKE TO CALL THEM.

AND THOSE FLEX SPACES ARE DESIGNED TO KIND OF GO A VARIETY OF WAYS WHERE SOMEONE MAY HAVE, UM, A LITTLE BIT HEAVIER USE.

SOME MAY HAVE A SHOWROOM IN THERE.

SOME MAY BE SHIPPING, SOME HAVE, YOU KNOW, A COUPLE OF TRUCKS, BUT MAYBE NOT TO THE FULL ON INDUSTRIAL SIZE.

THIS IS A MANUFACTURING FACILITY, ALTHOUGH IT DOESN'T LOOK LIKE THEY'RE REALLY, I MEAN, IN YOUR CASE STUDY HERE, THAT THERE'S A MUCH OF AN INCREASE IN PRODUCTION FROM THEIR CURRENT, THESE CURRENT SUGGESTED LEVELS.

UH, BUT AS A MANUFACTURING, WE'RE GOING TO MAKE IT, WE'RE GOING TO BRING IN RAW MATERIALS.

WE'RE GOING TO PUT IT TOGETHER.
